Hidden Malta Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Hidden Malta website, mobile application, and related services (collectively, the "Services").

Hidden Malta is published and operated by Vanitas Productions LLC, a California limited liability company ("Vanitas Productions," "we," "our," or "us").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you should not access or use the Services.

1. Eligibility

You must be at least thirteen (13) years of age to use the Services.

If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and permission of a parent or legal guardian.

2. License to Use the Services

Subject to these Terms, Vanitas Productions grants you a limited, non-exclusive, non-transferable, revocable license to access and use Hidden Malta solely for your personal, non-commercial use.

This license does not transfer ownership of the Services or any intellectual property.

3. Intellectual Property

Hidden Malta, including but not limited to:

  • software

  • application design

  • maps

  • narration

  • historical text

  • graphics

  • photographs

  • logos

  • trademarks

  • audio recordings

  • animations

  • website content

are protected by copyright, trademark, and other intellectual property laws.

All photographs, narration, historical content, software, graphics, and other materials available through Hidden Malta are protected by copyright and other intellectual property laws. Additional information regarding ownership and permitted use is available in the Copyright & Intellectual Property Notice.

Nothing contained within the Services grants you ownership of any intellectual property.

4. Permitted Use

You may:

  • Download the App through authorized app stores.

  • Purchase premium content through authorized in-app purchases.

  • Use the Services for your personal travel and educational enjoyment.

  • Share links to the Website or App Store listing.

5. Prohibited Activities

You may not:

  • Copy or redistribute the App.

  • Copy or redistribute narration.

  • Copy historical text for commercial purposes.

  • Reverse engineer the application.

  • Circumvent premium access controls.

  • Attempt unauthorized access to our systems.

  • Remove copyright notices.

  • Use the Services for unlawful purposes.

  • Resell or sublicense any portion of the Services.

6. Premium Content

Certain features are available only through paid purchases.

Premium purchases are processed exclusively through:

  • Apple In-App Purchases

  • Google Play Billing

Purchase entitlements are managed through RevenueCat.

Refund requests are governed by the policies of Apple or Google, as applicable.

Vanitas Productions cannot authorize refunds for purchases processed directly by Apple or Google.

7. Location Services

Location Services are optional.

If enabled, Hidden Malta may access your device's location while the App is open to:

  • identify nearby tour stops;

  • improve your tour experience; and

  • provide optional haptic notifications when you approach a stop.

Location tracking does not continue after the App is closed.

8. Historical Content

Hidden Malta is intended as an educational and cultural resource.

Although every effort is made to ensure historical accuracy, historical scholarship evolves over time.

The Services may contain interpretations, opinions, or summaries based upon historical sources available at the time of publication.

Vanitas Productions makes no guarantee that every historical statement is free from error or omission.

9. Safety

Hidden Malta is intended to complement—not replace—your own judgment.

While using the Services, you remain solely responsible for:

  • obeying traffic laws;

  • remaining aware of your surroundings;

  • respecting private property;

  • following posted rules at historic sites;

  • complying with opening hours and admission requirements;

  • exercising reasonable caution while exploring.

Do not allow the App to distract you while walking, crossing streets, or navigating unfamiliar environments.

10. Availability

Historic sites, museums, churches, gardens, and attractions may:

  • change operating hours;

  • close without notice;

  • restrict access;

  • undergo restoration;

  • charge admission fees.

Vanitas Productions is not responsible for changes made by third parties.

11. Third-Party Services

Hidden Malta integrates with third-party providers, including:

  • Apple

  • Google

  • Squarespace

  • RevenueCat

  • Firebase

Your use of those services remains subject to their respective terms and privacy policies.

12. Privacy

Your privacy is important to us.

Our collection and use of personal information are governed by the Hidden Malta Privacy Policy, which forms part of these Terms.

13. Updates

We may:

  • improve;

  • modify;

  • suspend; or

  • discontinue

any portion of the Services at any time.

We are under no obligation to continue supporting any particular feature indefinitely.

14. Disclaimer

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, Vanitas Productions disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • the Services will always be available;

  • all content will be error free;

  • every feature will function without interruption.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Vanitas Productions LLC and its officers, employees, contractors, licensors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Services.

Our total liability for any claim shall not exceed the amount you paid for the applicable premium content giving rise to the claim, if any.

16. Indemnification

You agree to indemnify and hold harmless Vanitas Productions LLC from claims arising out of:

  • your misuse of the Services;

  • violation of these Terms; or

  • infringement of another person's rights.

17. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in California.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

19. Changes to These Terms

We may revise these Terms periodically.

The Effective Date at the top of this document will indicate the latest revision.

Continued use of the Services following publication of revised Terms constitutes acceptance of the updated Terms.
