Hidden Malta End User License Agreement (EULA)

Effective Date: August 8, 2026

This End User License Agreement ("Agreement" or "EULA") is a legally binding agreement between you ("you," "your," or "User") and Vanitas Productions LLC, a California limited liability company ("Vanitas Productions," "we," "our," or "us"), governing your installation and use of the Hidden Malta mobile application and any associated downloadable content, updates, features, and related software (collectively, the "Application").

By downloading, installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree, do not install or use the Application.

1. License Grant

Subject to your compliance with this Agreement, Vanitas Productions grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Application on devices that you own or control for your personal, non-commercial use.

This license is granted—not sold.

No ownership rights in the Application are transferred to you.

2. Ownership

The Application, including all software, source code, object code, user interface design, maps, photographs, narration, historical content, audio recordings, artwork, graphics, trademarks, logos, databases, documentation, and all associated intellectual property rights are and shall remain the exclusive property of Vanitas Productions LLC or its licensors.

Certain photographic works appearing within the Application may remain the property of individual photographers and are used under license or with permission, including works credited to Chad Kordt-Thomas where applicable.

All rights not expressly granted under this Agreement are reserved.

3. Permitted Use

You may:

  • Install the Application through authorized app stores.

  • Use the Application on compatible devices.

  • Download officially provided tour content.

  • Purchase premium content through authorized in-app purchases.

  • Use the Application for your own personal travel and educational purposes.

4. Restrictions

You may not:

  • Copy, modify, adapt, translate, or create derivative works of the Application.

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code.

  • Circumvent licensing or premium access mechanisms.

  • Redistribute or resell the Application or its content.

  • Copy or redistribute narration, historical text, maps, photography, or other copyrighted materials except as expressly permitted by law.

  • Remove copyright, trademark, or attribution notices.

  • Use the Application in any unlawful manner.

5. Premium Content

Certain features and content are available only through paid purchases.

Premium purchases are processed through:

  • Apple In-App Purchases

  • Google Play Billing

Purchase entitlements are managed through RevenueCat.

Vanitas Productions does not receive or store your payment card information.

Refunds for purchases are governed by the applicable policies of Apple or Google.

6. Location Services

The Application may request permission to access your device's location.

Location Services are optional.

If enabled:

  • Location is accessed only while the Application is open and actively in use.

  • Location is used solely to improve your tour experience by identifying nearby stops and providing optional haptic notifications.

  • Background location tracking is not performed.

  • Location history is not stored.

You may enable or disable Location Services at any time through your device settings.

7. Updates

Vanitas Productions may periodically release updates, enhancements, corrections, or new versions of the Application.

Some updates may be required for continued compatibility or functionality.

This Agreement applies to all updates unless accompanied by separate license terms.

8. Availability

The Application relies upon third-party services including Apple, Google, RevenueCat, and mapping or hosting providers.

We do not guarantee uninterrupted availability of the Application or every feature.

Historic sites, museums, churches, gardens, and attractions may:

  • close without notice;

  • change operating hours;

  • restrict access; or

  • modify admission policies.

Vanitas Productions is not responsible for decisions made by third parties.

9. Historical Information

The Application presents carefully researched historical information for educational and cultural purposes.

Although every reasonable effort has been made to ensure historical accuracy, scholarship evolves over time.

Historical interpretations, dates, and conclusions may change as additional research becomes available.

Nothing contained within the Application should be considered professional historical, archaeological, legal, or academic advice.

10. Safety

You remain solely responsible for your own safety while using the Application.

Do not permit the Application to distract you while:

  • walking;

  • crossing streets;

  • driving;

  • cycling; or

  • navigating unfamiliar environments.

Users remain responsible for complying with all applicable laws, regulations, property restrictions, and posted notices.

11. Privacy

Your use of the Application is also governed by the Hidden Malta Privacy Policy.

The Privacy Policy is incorporated into this Agreement by reference.

12. Termination

This Agreement remains effective until terminated.

It will automatically terminate if you violate any provision of this Agreement.

Upon termination you must cease using the Application and destroy any copies not retained automatically by your device or applicable law.

Sections concerning ownership, intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

13. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANITAS PRODUCTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT:

  • THE APPLICATION WILL OPERATE WITHOUT INTERRUPTION;

  • THE APPLICATION WILL BE ERROR FREE;

  • ALL HISTORICAL INFORMATION WILL BE COMPLETE;

  • EVERY FEATURE WILL REMAIN AVAILABLE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANITAS PRODUCTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PREMIUM CONTENT GIVING RISE TO THE CLAIM.

15. Export Compliance

You agree not to use or export the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained.

You represent that you are not located in any country subject to U.S. embargoes or identified on any applicable U.S. government restricted-party list.

16. Third-Party Beneficiary (Apple)

If you obtained the Application through Apple's App Store:

Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement.

Upon your acceptance of this Agreement, Apple shall have the right to enforce this Agreement against you as a third-party beneficiary.

Nothing in this Agreement limits Apple's rights under its App Store Terms and Conditions.

17. Governing Law

This Agreement shall be governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Any legal proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in California.

18. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

This Agreement, together with the Hidden Malta Terms of Use and Privacy Policy, constitutes the complete agreement between you and Vanitas Productions LLC regarding the Application.
